- In these terms and conditions, we or us means Onerail and all subsidiaries (collectively Onerail ).
- Please read these terms and conditions carefully as they apply to your use of this Internet site (Site). By using this Site you agree to be bound by these terms and conditions.

5. Limitation of Our Liability
- To the extent permitted by law, you agree that in no event will we be liable to you or any person in contract, tort (including but not limited to negligence), under statute or any other basis for any consequential, special, incidental, indirect, exemplary or punitive damages, including claims for lost profits, loss of business, loss of use, lost savings, even if we have been advised of the possibility of such damages.

Except if required by Applicable Law, we specifically do not warrant that this Site or the Content will meet your requirements, or that such use or operation will be uninterrupted, virus free or error free.
- Nothing in these terms and conditions exclude restricts or modifies any condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified, which may include Part V of the Trade Practices Act 1974 (Cth) and corresponding provisions of State or Territory legislation which contain provisions including implied terms and warranties which operate to protect the purchasers of goods and services in various circumstances.
- If any condition or warranty is implied into this agreement under the Trade Practices Act 1974 (Cth) or any equivalent State or Territory legislation and cannot be excluded, and we are able to limit your remedy for a breach of such a condition or warranty, then our liability for breach of the condition or warranty is limited:
- in the case of goods, at our option, either the resupply of the goods or the payment of the costs of having the goods resupplied;
- in the case of services, at our option, either the resupply of the services or payment of the cost of having the services resupplied.
- To the extent permitted by law our aggregate liability to you, whether for breach of these terms or in negligence or in any other tort or for any other common law or statutory cause of action arising in relation to these terms, the Site or the Content is limited to A$100.
- If a jurisdiction does not allow the exclusion or limitation of liability in accordance with paragraph (a) or (f) but allows a limitation of a certain maximum extent then our liability is limited to that extent.
6. Intellectual Property Rights
- You acknowledge that the Content on the Site is subject to copyright and possibly other intellectual property rights.
- Unless you are expressly authorised by law you must not yourself, or participate in or permit any other person, to:

7. General Provisions
- If any part of this agreement is held to be unenforceable, the unenforceable part must be given effect to the greatest extent possible and the remainder will remain in full force and effect.
- These terms and conditions are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia.
